பெங்களூரு: ஜெ.,ஐகோர்ட்டில் இன்று நடந்த விசாரணை- live updates

பெங்களூரு: ஜெ., வை ஜாமினில் விடுதலை செய்ய வேண்டும் என வலியுறுத்தி பெஙகளூரு ஐகோர்ட்டில் இன்று நடந்த விசாரணையின்போது , ஜெ.,வுக்கு உடல் நலம் சரியில்லை. அவர் ஜாமினில் விடுவிக்கப்பட்டால் அதிகாரத்தை எதுவும் தவறாக பயன்படுத்த மாட்டார் என்றும் பிரபல வழக்கறிஞர் வாதிட்டார். ஆனால் அவரை விடுவிக்க கூடாது என அரசு வக்கீல் பவானிசிங் வாதிட்டார். கோர்ட் வளாகத்தில் அ.தி.மு.க.,வக்கீல்கள் அதிகம் குவிந்தததால் கோர்ட்டில் பரபரப்பான சூழல் நிலவியது. இதனால் வக்கீல்களை கட்டுப்படுத்த நீதிபதி சந்திரசேகரா போலீசாருக்கு உத்தரவிட்டார்.

இன்றைய ஜாமின் மனு விசாரணையில் , உச்சநீதிமன்ற தீர்ப்பை மேற்கோள் காட்டி ஜெ., வுக்கு ஜாமின் வழங்குங்கள் ; என பிரபல வக்கீல் ராம்ஜெத்மலானி தனது வாதுரையில் எடுத்துரைத்தார். தொடர்ந்து அவர் வாதிடுகையில், இந்த வழக்கில் சாட்சிகள் ஜெ.,வுக்கு ஆதரவாகத்தான் சாட்சியம் அளித்துள்ளனர். ஆனால் சிறப்பு கோர்ட் நீதிபதி அளித்த தீர்ப்பு தவறானது. ஊழல் தடுப்பு சட்டத்தின் படி முறையான விசாரணை நடக்கவில்லை. ஜெ.,தரப்பில் உள்ள ஆதாரங்களை சரியாக வழங்காமல் நீதிபதி தீர்ப்பளித்துள்ளார். இந்த தீர்ப்பை நிறுத்தி வையுங்கள். ஜாமின் உடடியாக வழங்குங்கள் . இவருக்கு ஜாமின் வழங்காத பட்சத்தில் தமிழகத்தில் பதட்டம் நீடிக்கும். ஜெ.,வுக்கு ஆயுள் தண்டனையோ, மரணத்தண்டனையோ விதிக்கப்படவில்லை. இவர் உடல்நலமும் பாதிக்கப்பட்டுள்ளார். இவருக்கு இதனால் ஜாமின் வழங்குவதில் தவறு இல்லை. இது போன்ற வழக்கில் சிறை தண்டனை பெற்ற லாலு பிரசாத்துக்கு வழங்கியது போல் ஜெ.,வுக்கு ஜாமின் வழங்கலாம். என பல்வேறு உச்சநீதிமன்ற தீர்ப்பை மேற்கோள் காட்டினார். ஜெத்மலானி ஒரு மணி நேரம் வாதிட்டார்.

மாதம் ஒரு ரூபாய் சம்பளம் : அரசு தரப்பில் ஆஜரான வழக்கறிஞர் பவானிசிங், தனது வாதுரையில், மாதம் ஒரு ரூபாய் சம்பளம் வாங்கிய ஜெ., பல கோடி சொத்துக்களை குவித்துள்ளார். இது சட்டப்படி குற்றம் ஆகும். இது தொடர்பாக குற்றச்சாட்டு பதியப்பட்டுள்ளது. இவர் ஜாமினில் விடுவிக்கப்பட்டால் சாட்சியங்களை கலைப்பதுடன் , அதிகாரத்தையும் தவறாக பயன்படுத்துவார். எனவே இவரை ஜாமினில் விடுவிக்க முடியாது.

இதற்கு குறுக்கிட்ட ஜெத்மலானி, 17 ஆண்டுகள் வழக்கு நடந்துள்ளது. இதுவரை அவர் எந்தவொரு தவறான வழியிலும் ஈடுபடவில்லை. 2 முறை முதல்வராக இருந்துள்ளார். எங்கும் ஓடவில்லை. அரசியல் சூழ்ச்சி காரணமாக வழக்கு போடப்பட்டுள்ளது. என்றார்.

சசி வக்கீல் வாதம் : சசிகலா, இளவரசி தரப்பில் வக்கீல் பிரபல வழக்கறிஞர் அமித்தேசாய் தனது வாதத்தில் , இந்த வழக்கில் கோர்ட்டில் ஜெராக்ஸ் ஆவணங்களே அதிகம் வழங்கப்பட்டுள்ளன. சசிகலாவின் பினாமி பெயரில் சொத்துக்கள் வாங்கவில்லை.
